Terms of Service
Last Updated: October 28, 2026
These Terms of Service (the "Terms") are a binding legal agreement between you and Rethink Routine LLC, which owns and operates Jobiteer (together, "Jobiteer," "we," "us," or "our"). They apply to the Jobiteer website, the Jobiteer web app, the Jobiteer iPhone and Android apps, and every feature, tool, message, and notification they provide (together, the "Platform").
PLEASE READ SECTION 32 CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH JOBITEER THROUGH INDIVIDUAL BINDING ARBITRATION, NOT IN COURT, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. YOU CAN OPT OUT OF ARBITRATION WITHIN 30 DAYS, AS SECTION 32 EXPLAINS. SECTIONS 6, 27, 28, 29 AND 30 ALSO LIMIT JOBITEER'S RESPONSIBILITY TO YOU, INCLUDING FOR JOBITEER'S OWN NEGLIGENCE.
1. Agreeing to These Terms
You accept these Terms when you create an account, check a box agreeing to them, post a job, message another user, hire or are hired by another user, buy anything on the Platform, or otherwise use the Platform. If you don't agree, don't use the Platform.
Our Privacy Policy explains how we handle your information and is part of these Terms. Any rules, limits, prices, or instructions shown on the Platform at the time you use a feature (for example, how many credits a lead costs or when a review window closes) are also part of these Terms.
If you use the Platform for a business, company, or other organization, you agree to these Terms on its behalf and promise you have the authority to do so. In that case "you" means both you and that organization.
2. The Short Version
This summary is here to help you, but the full Terms below are what count.
- Jobiteer is a self-service tool that lets homeowners and contractors find each other and work together. We are not a contractor, an employer, a broker, a payment service, or a party to any job.
- We do not vet anyone. No background checks, no license checks, no insurance checks, no identity checks. Everything a user says about themselves is their own claim. Doing your own research is your job.
- The Platform runs itself. There is no support team, no dispute mediation, and no one who will step in between users. The tools on the Platform (blocking, reporting, deleting your account, and so on) are how you handle problems.
- Many things happen automatically, on schedules and rules described on the Platform. You agree to those automatic actions.
- Money for work never passes through Jobiteer. Credits and the Jobi plan are the only things you buy from us.
- Our responsibility to you is very limited, and disputes with us go to individual arbitration.
3. Eligibility and Accounts
You must be at least 18 years old, able to form a binding contract, and not barred from using the Platform under any law or by an earlier suspension. The Platform is for use in the United States, for homes and jobs located in the United States.
You agree to give accurate information, keep it up to date, and keep only one personal account (a company may also have its own team, see Section 11). You may not create an account for someone else without their permission, or create accounts to get extra free credits, avoid a block or suspension, or get around any limit.
You are responsible for everything that happens under your account, including actions taken by anyone you let use your device or login, and actions taken automatically by features you turned on. Keep your password private. The Platform may remember a device you've signed in on so you aren't asked to confirm it again; if you lose a device or think someone else has access to your account, change your password right away.
4. A Self-Service Platform: No Support, No Mediation
The Platform is designed to run on its own and to be managed by its community of users. You understand and agree that:
- Jobiteer does not provide customer support, account recovery beyond the Platform's built-in tools, mediation, arbitration, or any other help with disputes between users. We have no duty to respond to messages, complaints, or requests, except where the law requires a response.
- We do not monitor jobs, messages, visits, payments, or reviews, and we have no duty to do so.
- We do not investigate or take sides in disagreements about quality, price, scope, timing, damage, payment, cancellations, no-shows, reviews, or anything else between users.
- The Platform's own features (blocking, reporting, turning features off, editing your profile, exporting your records, and deleting your account) are the ways to handle problems. If those aren't enough, your remedies are against the other user, through the courts, law enforcement, or other services, not against Jobiteer.
- Anything we do choose to do (for example, hiding a post or restoring one) is at our sole discretion, is not a promise to do it again, and does not create any duty to you or anyone else.
5. What Jobiteer Is, and Isn't
Jobiteer is an online venue and set of software tools. Homeowners and others who need work done ("Homeowners") post jobs, and independent contractors, tradespeople, and companies ("Contractors") find those jobs, message Homeowners, and use the Platform's business tools. Jobiteer:
- is not a party to any quote, estimate, agreement, contract, invoice, plan, or transaction between users;
- does not employ, supervise, direct, control, train, or recommend any Contractor, and does not employ any Contractor's workers;
- is not a licensed contractor, general contractor, home improvement company, staffing agency, broker, agent, or employer of any kind;
- does not perform, inspect, schedule on its own judgment, supervise, guarantee, warrant, or insure any work;
- does not collect, hold, transfer, or refund payments between users, and is not a payment processor, escrow agent, money transmitter, or lender; and
- is not an agent, representative, or fiduciary of any user.
Contractors are independent businesses (or workers of those businesses), not Jobiteer's employees, contractors, or agents. Any agreement to do work, and its price, scope, timing, warranty, and every other term, is only between the users involved.
6. We Do Not Vet, Verify, or Screen Anyone
THIS IS ONE OF THE MOST IMPORTANT SECTIONS OF THESE TERMS. JOBITEER DOES NOT VET, SCREEN, OR VERIFY ANY USER, CONTRACTOR, COMPANY, HOMEOWNER, JOB POST, OR CLAIM, AND MAKES NO PROMISE ABOUT ANY OF THEM.
We do not run background checks, criminal history checks, sex offender registry checks, identity checks, license checks, insurance checks, bonding checks, permit checks, credit checks, reference checks, or any other screening. Specifically:
- Names, photos, and business details are whatever the user typed in. We don't confirm that anyone is who they say they are, that a business exists, or that someone works for the company they're listed under.
- Insured, Bonded, and Warranty badges are claims the Contractor makes about themselves. We don't check them. A badge is not a certification from Jobiteer.
- Licenses. We don't check whether a Contractor holds any license, registration, or permit that the law requires for the work. Requirements differ by state, county, city, and trade.
- Ratings and reviews are opinions of other users. We don't check them for truth or completeness. A review shows that two accounts were connected on the Platform, not that work was done well, finished, or done at all.
- Completed-job counts, hire counts, response times, statuses (such as "on a job" or "on vacation"), and similar numbers are automatic tallies of activity on the Platform, not a measure of quality, reliability, or safety.
- "On my way," "Arrived," and other location notices come from a single reading of the Contractor's device location. "Arrived" or "verified" only means that reading was near the job address. Device locations can be wrong or faked, and these notices don't confirm who is at your door.
- Job posts are written by Homeowners. We don't confirm that a job, a property, a budget, or a Homeowner is real, safe, or legal.
- Price ranges, estimates, and AI answers are automatic and may be wrong (see Sections 14 and 16).
No user on Jobiteer is licensed, insured, bonded, background-checked, or qualified just because they are on Jobiteer. Never treat an account, badge, rating, review, count, notice, or anything else on the Platform as a substitute for your own research.
7. Your Own Research and Judgment
You alone decide whom to deal with, whom to let into your home or onto your property, which job to take, and which property to go to. Before you hire or work with anyone, you agree to do your own research, which may include checking licenses with the state or local agency, asking for proof of insurance and calling the insurer, checking references and other review sites, getting written agreements, and checking permit requirements.
Contractors should use the same care with Homeowners and job posts, including judging whether a job, worksite, or person is legitimate and safe. Some accounts may act in bad faith.
Information on the Platform, including anything written by Jobi or other automatic features, is general information only. It is not legal, tax, accounting, insurance, safety, engineering, or professional advice.
8. If You're a Contractor
You promise and agree that:
- you hold, and will keep, every license, registration, permit, insurance policy, bond, and certification the law requires for the work you offer and do, and you will get any permits a job needs;
- everything you say about yourself and your business (including badges, specialties, prices, and experience) is true and kept current;
- you are solely responsible for your work, your workers, your subcontractors, your tools and vehicles, your safety practices, and any damage or injury connected to your work;
- you will follow every law that applies to you and your work, including building codes, contractor and home improvement laws, consumer protection laws (including any required written contracts, notices, and cancellation rights for sales made at a customer's home), lead-safe and other environmental rules, wage, employment, and worker classification laws, tax laws (including collecting and paying sales tax where required), and anti-discrimination laws;
- you are responsible for your own quotes, estimates, invoices, warranties, contracts, and collections; and
- you, not Jobiteer, are responsible for every message, booking, reply, follow-up, and lead unlock made by features you turn on, including Jobi (Section 14).
9. If You're a Homeowner
You promise and agree that:
- your job posts are accurate and lawful, and you have the right to have the work done at the property (for example, as owner, or with the owner's or landlord's permission);
- you are responsible for any permits, HOA or landlord approvals, and inspections your job needs, unless you agree in writing that the Contractor will handle them;
- you will tell Contractors about hazards you know of at the property (for example, pets, structural problems, asbestos, lead paint, mold, or electrical issues);
- you are responsible for deciding whom to let onto your property and for securing your valuables, pets, and family members; and
- you will pay Contractors as you agree with them, directly, outside the Platform.
10. Deals, Payments, and Disputes Between Users
All money for work moves directly between users, outside the Platform. Jobiteer never receives, holds, or sends that money, can't confirm whether a payment was made, can't refund it, and can't settle a payment dispute.
The Platform's estimate, invoice, plan, scheduling, and "paid" features are record-keeping tools. A document made with them is only what the users make of it: it is not a contract written, reviewed, or approved by Jobiteer, and it may not meet the legal requirements for contracts, invoices, liens, or notices where you are. Marking an invoice paid, confirming a job done, or accepting an estimate on the Platform doesn't by itself prove that work was done or money was paid.
Cancellations, no-shows, delays, refunds, deposits, warranties, change orders, damage, and every other issue between users are only between those users. You agree not to hold Jobiteer responsible for them (see Section 28).
11. Companies and Teams
A Contractor may set up a company on the Platform and invite others to join it as team members. If you own a company on the Platform ("Company Owner"):
- you are responsible for your team members' use of the Platform on the company's behalf, as if it were your own;
- leads your team unlocks for the company are paid from your credits, within the limits and approval settings you choose, and you're responsible for those settings;
- you can see your company's records, which include your team members' company jobs, customers' first names, visit times, estimates, invoices, ratings, expenses, mileage trips, and time entries, and you can move a company job (with its customer's contact details) from one team member to another;
- your Jobi plan may cover certain features for your team, such as the receipt reader; and
- you, not Jobiteer, are the employer or hiring party of your team members and are solely responsible for wages, overtime, expense reimbursement, payroll, taxes, worker classification, insurance, and employment law. The Platform's time, mileage, and cost features are business estimates, not payroll or timekeeping records that meet any legal standard.
If you join a company as a team member, you agree that the Company Owner can see the company records listed above, including your company time entries and mileage trips, and that company jobs and records stay with the company if you leave or are removed. Messages in your chats are not shown to the Company Owner.
12. Automatic Features and Actions Taken for You
The Platform runs on rules and schedules, not on people. You authorize the Platform to take the automatic actions described on the Platform for the features you use, and you agree to be bound by them as if you had taken them yourself. These include, as examples:
- closing job posts after a set time, asking whether you still need help, and moving a post back to the top of the feed with a discount;
- confirming a job is done, and sending an invoice the Contractor has prepared, if the other side doesn't respond within the time shown;
- booking or proposing the next visit of a recurring plan, marking visits missed, and ending plans after their length;
- opening, closing, and revealing reviews on the schedules shown, and marking jobs complete;
- sending reminders, follow-ups, and nudges to you and to other users, including messages about estimates and unpaid invoices that appear to come from a user;
- adding, resetting, and refunding credits under the Platform's rules, and unlocking leads with credits under settings you or your Company Owner chose; and
- hiding content that several users report.
Schedules, time limits, prices, and rules shown on the Platform may change. Automatic actions can be late, run twice, fail, or act on wrong information (for example, a wrong time zone or a calendar that isn't up to date). Check what the Platform did and fix it with the other user. Jobiteer is not responsible for the results of an automatic action, or of one that should have happened and didn't.
13. Location Features
Some features use your device's location when you tap them, such as "On my way" and "I'm here." When you use them, you agree that a reading of your location is sent to the Platform and that the other user in that chat sees an approximate area (for "On my way") or a map pin at your location (for a confirmed arrival), along with an estimated arrival time. Directions, travel times, and arrival estimates come from map services and may be wrong. Never use the Platform while driving in a way that takes your attention off the road.
The Platform doesn't track your location in the background. It also doesn't verify who is holding a device, and a location reading can be wrong or faked (see Section 6).
14. Jobi and Other AI Features
Jobi is the Platform's AI assistant. Depending on your settings and plan, Jobi may reply to Homeowners in a Contractor's chats, offer and confirm appointment times, reschedule, send follow-ups, unlock leads with the Contractor's credits under the Contractor's rules, give the Contractor a private read on a conversation, read receipts to fill in expenses, and suggest prices. Jobi's messages are labeled as AI in the chat, and Homeowners can turn Jobi off for their chat.
AI makes mistakes. Jobi's replies, readings, summaries, and suggestions are produced automatically by an outside AI service, and may be incomplete, out of date, or wrong. They are not a quote, offer, promise, guarantee, or advice from Jobiteer or from the Contractor, unless the Contractor confirms them directly. A Contractor who turns on Jobi:
- is responsible for Jobi's settings and the information they give it, and for what Jobi says and does in their chats, including the appointments it confirms and the leads it unlocks (which use credits that are refunded only under the Platform's normal rules);
- should review what Jobi has done; and
- must check every field the receipt reader fills in (vendor, total, date, category) before relying on it. Receipt reading has limits shown on the Platform, which may change at any time.
Don't send passwords, bank or card numbers, Social Security numbers, health information, or other sensitive information in chats or photos. The Platform removes some contact details before sending a chat to the AI service, but can't promise to catch everything.
15. Business Records, Expenses, Mileage, Time, and Taxes
The Platform offers tools to record estimates, invoices, expenses, receipts, mileage, time, profit, and tax summaries. These tools are a convenience only:
- They are not tax, accounting, bookkeeping, payroll, or legal advice or services. Category names (including any that match IRS form lines), mileage figures, profit numbers, and tax summaries are labels and estimates. Ask a qualified tax professional before relying on them.
- You are responsible for the accuracy of your records, for keeping the original receipts and records the law requires, and for every tax filing, deduction, and payment.
- Keep your own copies. Use the export features regularly. Jobiteer is not a records storage service and is not responsible for lost, changed, or deleted records, including when your account is closed or the Platform shuts down.
16. Price Information
The Platform may show price ranges, "what others paid," per-unit estimates, and suggested budgets. These are automatic estimates based on past activity on the Platform and other inputs. They are not quotes, appraisals, or guarantees of what any job will cost, and may be wrong or out of date.
When a Contractor makes an invoice on the Platform for a job that is completed, Jobiteer may use that invoice's total, its line-item quantities and units, and the job's type, size, city, state, zip code, and month (never names, contact details, street addresses, messages, or photos) to calculate combined price information that is shown to other users and never tied to you or a specific job. By making an invoice on the Platform, you give Jobiteer a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use that pricing information this way, including after your account is closed.
17. Reviews and Ratings
Users who were connected through a hire may review each other, on the schedule and rules shown on the Platform (for example, reviews stay hidden until both are in or the window ends, and then can only be changed in limited ways).
- Your review must be honest, based on your own real experience, and not false or misleading. Don't write reviews of yourself, your company, your competitors, or anyone you have a conflict of interest with, and don't offer or accept anything of value for a review or for changing or removing one.
- Don't threaten a bad review to get something, and don't use the Platform to retaliate against someone for a review.
- Reviews are the reviewer's own words and opinions, not Jobiteer's. Jobiteer does not edit reviews for truth, does not remove reviews because someone disagrees with them, and does not mediate review disputes. The person being reviewed can post a public reply.
- Jobiteer may hide, limit, or remove a review, or decide not to show one, under the Platform's rules or when we believe it breaks these Terms or the law. Jobiteer has no duty to do so.
18. Your Content
"Content" means anything you post, upload, send, or create on the Platform, including job posts, photos, profile details, messages, reviews, replies, estimates, invoices, receipts, and notes. You keep ownership of your Content and are solely responsible for it.
You give Jobiteer a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, copy, process, adapt (for example, resize photos or remove contact details), display, and distribute your Content to operate, provide, secure, improve, and promote the Platform, including showing public Content (such as job posts and profiles) to people who aren't signed in and in search engines. This license continues for Content other users can still see after you delete it or close your account (for example, messages you sent them and reviews you wrote), and for the pricing license in Section 16.
You promise that you have every right needed to post your Content and to give us this license, and that your Content doesn't break any law or anyone's rights, including privacy and publicity rights. Get permission before posting photos of other people or their property.
Photos can contain hidden information, such as the location where they were taken. The Platform tries to remove it, but can't promise to, so check your photos before you post them.
We don't review Content before it's posted and don't promise to store it. We may remove, hide, or limit any Content at any time for any reason.
19. Reporting, Blocking, and Moderation
You can block other users and report job posts and users through the Platform. A blocked user can't message you. Reports are handled automatically: for example, a post reported by enough different users may be hidden without anyone reviewing it. We may review reports when we choose to, but we have no duty to review, respond to, or act on any report, and we don't tell reporters what, if anything, was done.
If you are in danger, or a crime has happened, contact the police or 911. Jobiteer is not an emergency or safety service.
20. Things You May Not Do
You agree not to, and not to help anyone else:
- give false information about your identity, business, licenses, insurance, bonding, warranties, experience, or a job;
- use the Platform for anything illegal, harmful, fraudulent, deceptive, or unsafe, or to offer work you aren't legally allowed to do;
- harass, threaten, stalk, discriminate against, or abuse anyone, or post hateful, sexual, violent, or obscene material;
- post spam, ads unrelated to a job, fake jobs, fake reviews, or bait-and-switch offers;
- scam users, ask for payment for jobs that don't exist, or ask users for passwords, bank details, or codes;
- collect or use other users' information for anything other than the job you're discussing, or contact users who have blocked you;
- abuse credits, refunds, discounts, free credits, or limits (for example, with extra accounts, fake posts, or arranged unlocks);
- scrape, crawl, copy, or harvest the Platform or its data, or use it to train AI models, except as search engines normally index public pages;
- use bots or automation to access the Platform, other than features the Platform itself provides;
- probe, test, or break the Platform's security, get around its limits, use another person's account, or reverse engineer the apps, except where the law forbids this restriction;
- upload malware, or interfere with or overload the Platform; or
- break any law, including privacy, consumer protection, contractor licensing, anti-discrimination, and export laws.
21. Credits
Contractors use credits to unlock jobs and message Homeowners. Credits are a limited, revocable license to use a Platform feature. They are not money, a deposit, a gift card, or property. They have no cash value, can't be sold, transferred, or exchanged for cash, and aren't refundable, except where the Platform's rules or the law say otherwise.
- The price of each credit pack, and the number of credits each lead costs, are shown on the Platform and may change at any time. The price shown when you buy is the price you pay.
- Free credits, when offered, are topped up on a schedule shown on the Platform up to a set amount, and don't build up beyond that amount. Free credits are used before paid credits. Bonus credits may be given at our discretion. We may change or end free and bonus credits at any time.
- Paid credits don't expire while your account is open. They end, without refund, when your account is deleted or terminated for breaking these Terms, unless the law requires otherwise.
- Credits may be returned automatically under the Platform's rules (for example, for a lead that never answers). Those rules are the only refunds of credits. Unlocking a lead buys the chance to message a Homeowner, not a reply, a hire, or a job.
- If a payment is reversed, refunded, or charged back, we may remove the credits it bought, even if that leaves your balance at zero, and may suspend your account.
- Purchases on the website are processed by Stripe, and in the apps by Apple or Google. Their terms also apply to your payment, and any refund of an app store purchase is decided by Apple or Google under their rules.
22. The Jobi Plan Subscription
The Jobi plan is a subscription that renews automatically every month at the price shown when you subscribe, and you will be charged every month until you cancel. You can cancel anytime: on the website through the billing page, or in the iPhone or Android app through your App Store or Google Play subscriptions. Cancelling stops the next renewal; the plan stays on until the end of the month you've paid for. Partial months aren't refunded, except where the law requires.
We may change the plan's price for future months after giving you notice through the Platform or by email, and you can cancel before the new price applies. We may change, add, or remove plan features and limits (for example, how many receipts can be read each month) at any time. Deleting your account cancels a website or Google Play subscription for future months, but a subscription bought through Apple must be cancelled in your Apple account.
23. Other Companies' Services and the App Stores
The Platform uses and links to services run by other companies (for example, maps, payments, AI, email, and notifications). Those services have their own terms and privacy policies. Jobiteer doesn't control them and isn't responsible for them, for their availability, or for any harm they cause.
If you got the app from Apple's App Store: these Terms are between you and Jobiteer only, not Apple. Apple is not responsible for the app or its content, and has no duty to provide maintenance or support for it. If the app fails to meet any warranty that can't be disclaimed, you may notify Apple, and Apple may refund the app's purchase price (if any); to the fullest extent the law allows, Apple has no other warranty obligation. Apple is not responsible for any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that it infringes someone's intellectual property. You promise you are not located in a country subject to a U.S. government embargo or listed as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also follow the App Store's terms. If you got the app from Google Play, Google's terms also apply to your use of Google Play.
24. Jobiteer's Property and Your Feedback
The Platform, its software, design, text, logos, the name Jobiteer, and all related intellectual property belong to Jobiteer or its licensors. We give you a limited, personal, revocable, non-transferable license to use the Platform under these Terms. We keep every right not expressly given to you.
If you send us ideas, suggestions, or feedback, we may use them for any purpose without paying you or owing you anything.
25. Copyright Complaints
If you believe Content on the Platform infringes your copyright, send a notice to our designated agent at jobiteer@gmail.com with the subject "Copyright Notice," including: your physical or electronic signature; a description of the copyrighted work; where the material is on the Platform (a link or exact location); your name, address, phone number, and email; a statement that you have a good faith belief the use isn't authorized by the owner, its agent, or the law; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner. We may remove the material and may terminate the accounts of repeat infringers. If your Content was removed and you believe it was a mistake, you may send a counter-notice with the information the Digital Millennium Copyright Act requires. Sending a false notice can make you liable for damages.
26. Safety
Meeting people from the internet, letting them into your home, and going into someone else's home all carry real risks. Use common sense: meet only when you're comfortable, let someone know where you'll be, keep valuables and medicines secured, don't pay large amounts upfront to someone you don't know, and trust your instincts. These tips are suggestions only; following them doesn't guarantee your safety, and Jobiteer has no duty to keep you safe from other users.
27. Assumption of Risk
You understand that using the Platform, and dealing with other users online and in person, involves risks, including property damage, bodily injury, illness, death, theft, fraud, identity theft, non-payment, poor, unfinished, unlicensed, or unsafe work, and disputes. YOU KNOWINGLY AND VOLUNTARILY ACCEPT ALL OF THOSE RISKS.
28. Release and Promise Not to Sue
TO THE FULLEST EXTENT THE LAW ALLOWS, YOU RELEASE, WAIVE, AND FOREVER DISCHARGE JOBITEER AND RETHINK ROUTINE LLC, AND THEIR OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, AND ASSIGNS (THE "JOBITEER PARTIES"), FROM EVERY CLAIM, DEMAND, LOSS, AND DAMAGE OF ANY KIND, KNOWN OR UNKNOWN, ARISING OUT OF OR RELATED TO:
- ANY OTHER USER'S ACTS, OMISSIONS, WORK, CONTENT, OR CONDUCT, ONLINE OR OFFLINE;
- ANY AGREEMENT, PAYMENT, JOB, VISIT, OR DISPUTE BETWEEN YOU AND ANOTHER USER;
- YOUR RELIANCE ON ANY PROFILE, BADGE, RATING, REVIEW, COUNT, LOCATION NOTICE, PRICE, AI OUTPUT, OR OTHER INFORMATION ON THE PLATFORM; AND
- ANY AUTOMATIC ACTION OF THE PLATFORM.
THIS RELEASE INCLUDES CLAIMS BASED ON THE JOBITEER PARTIES' OWN NEGLIGENCE. You also promise not to start, join, or take part in any lawsuit or other proceeding against a Jobiteer Party about a released claim, except to enforce this Section.
This release doesn't cover claims for the Jobiteer Parties' gross negligence, willful misconduct, or fraud, or any claim that by law can't be released. If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You also waive any similar law anywhere else.
29. Disclaimer of Warranties
THE PLATFORM, AND EVERYTHING ON IT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT THE LAW ALLOWS, JOBITEER DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTIES FROM A COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the above, Jobiteer does not promise that the Platform will be available, on time, secure, free of errors, viruses, or data loss, or that any notification, reminder, automatic action, or message will be sent or received on time or at all. Jobiteer makes no promise about any user, job, work, Content, review, badge, price, location, or AI output. No advice or information from Jobiteer or the Platform creates any warranty not stated in these Terms.
30. Limitation of Liability
TO THE FULLEST EXTENT THE LAW ALLOWS, THE JOBITEER PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, JOBS, DATA, RECORDS, GOODWILL, OR REPUTATION, OR FOR PROPERTY DAMAGE, BODILY INJURY, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATED TO THESE TERMS, THE PLATFORM, OR ANY USER, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
TO THE FULLEST EXTENT THE LAW ALLOWS, THE JOBITEER PARTIES' TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM, ON ANY THEORY (CONTRACT, TORT INCLUDING NEGLIGENCE, STATUTE, OR OTHERWISE), WILL NOT BE MORE THAN THE GREATER OF (A) THE AMOUNT YOU PAID JOBITEER IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limits apply even if a remedy fails of its essential purpose, and they are an essential part of the bargain: the Platform could not be offered at its price, or for free, without them. Some places don't allow some of these limits, so some may not apply to you; in that case they apply as fully as that law allows.
31. Indemnification
To the fullest extent the law allows, you agree to defend, indemnify, and hold harmless the Jobiteer Parties from every claim, demand, loss, liability, damage, fine, cost, and expense (including reasonable attorneys' fees) made by anyone, arising out of or related to: your use of the Platform; your Content; your work or any work you request, offer, or allow; your dealings with any other user; your team members' use of the Platform, if you are a Company Owner; actions taken by features you turned on, including Jobi; or your breaking these Terms or any law or anyone's rights. We may take over the defense of any such claim at your cost, and you will cooperate. You may not settle a claim that affects a Jobiteer Party without our written consent.
32. Disputes With Jobiteer: Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
a. Try to resolve it first. Before starting arbitration or a small claims case, you and Jobiteer agree to try to resolve the dispute informally for 60 days. The person with the claim must send a written notice to the other (to Jobiteer at jobiteer@gmail.com with the subject "Notice of Dispute"; to you at the email on your account) with their name, the email on their account, a description of the dispute, and the relief wanted, signed personally by the person making the claim (not only by a lawyer). Any time limit to bring the claim is paused during these 60 days. This step is required, and a claim started without it may be dismissed.
b. Arbitration. Except as stated below, any dispute, claim, or controversy between you and any Jobiteer Party arising out of or relating to these Terms, the Platform, or your relationship with Jobiteer, whether it arose before or after you agreed to these Terms, and including any question about whether this section applies or can be enforced (which the arbitrator decides), will be resolved only by final, binding arbitration on an individual basis. The Federal Arbitration Act governs this section. The arbitration will be run by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (and, where they apply, its Mass Arbitration Supplementary Rules), as changed by this section, and will be held by video or phone, or in the county where you live, unless you and Jobiteer agree otherwise. Payment of filing and arbitrator fees will follow the AAA's rules. The arbitrator may award the same individual relief a court could, but only for you individually.
c. Exceptions. Either side may bring an individual claim in small claims court if it qualifies and stays there. Either side may ask a court to stop the misuse or infringement of intellectual property, or to stop unauthorized access to or interference with the Platform.
d. Class action and jury trial waiver. YOU AND JOBITEER EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. YOU AND JOBITEER EACH WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may not combine more than one person's claims. If a court decides that this waiver can't be enforced for a particular claim or kind of relief (for example, public injunctive relief), that claim or relief will be separated and decided in court after the individual arbitration ends, and everything else stays in arbitration.
e. Many similar claims. If 25 or more similar claims are brought against Jobiteer by the same or coordinated lawyers or organizations, the AAA's Mass Arbitration Supplementary Rules apply, and the parties agree to cooperate in good faith to resolve the claims efficiently, including by first arbitrating a small number of test cases. Time limits for the remaining claims are paused while that happens.
f. Opting out. You can opt out of this arbitration agreement by emailing jobiteer@gmail.com within 30 days after you first agree to these Terms, with the subject "Arbitration Opt-Out" and your name and the email on your account. Opting out doesn't affect any other part of these Terms, or any earlier arbitration agreement you made with us.
g. Changes. If we change this section, you may reject the change by emailing jobiteer@gmail.com within 30 days of the change taking effect; then the version you last agreed to keeps applying to you. A change won't apply to a claim we had already received notice of.
h. If this section doesn't apply. If this arbitration agreement is found not to apply to a claim, or you opted out, the claim will be decided only in the state or federal courts located in Texas, and you and Jobiteer agree to those courts' personal jurisdiction, subject to the jury trial and class action waivers above.
33. Time Limit to Bring a Claim
To the fullest extent the law allows, any claim you have against a Jobiteer Party must be brought within one (1) year after it arose, or it is permanently barred.
34. Governing Law
These Terms and any dispute with Jobiteer are governed by the Federal Arbitration Act and the laws of the State of Texas, without regard to its conflict-of-laws rules, except where the law of the place you live requires otherwise.
35. Suspension, Termination, and Ending the Platform
We may limit, suspend, or end your access to any part of the Platform, or delete your account or Content, at any time, with or without notice or a reason, including if we believe you broke these Terms, created risk or possible legal exposure for us or others, or haven't used your account for a long time. We have no duty to explain or to review that decision. If your account ends because you broke these Terms, any credits and the current month of any plan end without refund, unless the law requires otherwise.
You can stop using the Platform at any time and delete your account in your profile settings. Some information stays after deletion, as the Privacy Policy explains.
We may change, pause, or stop the Platform, or any feature, at any time, including ending the Platform entirely. If we end the whole Platform, we will try to give notice on the Platform so you can export your records, but we have no duty to keep, return, or provide any data afterward. We are not liable to you or anyone for any of these changes.
Sections that by their nature should last after these Terms end will do so, including Sections 4 through 7, 10 through 12, 14 through 18, 21, and 24 through 39.
36. Changes to These Terms
We may change these Terms at any time. We'll post the new version with a new "Last Updated" date, and for important changes we may also tell you through the Platform or by email, or ask you to agree again. Changes apply from the date posted, except as Section 32(g) says. If you keep using the Platform after a change, you accept the new Terms. If you don't accept them, stop using the Platform and delete your account.
37. Electronic Communications and Signatures
You agree that checking a box, tapping a button, or otherwise accepting these Terms electronically is your legal signature, with the same effect as signing on paper, under the federal E-SIGN Act and similar state laws. You agree to receive all notices, disclosures, agreements, and other communications from us electronically, through the Platform, push notifications, or the email on your account, and that these meet any legal requirement that they be in writing. Keep your email address current; a notice sent to it counts as received when sent. You can stop receiving electronic communications only by deleting your account.
38. Notices
We may give you notices through the Platform, by push notification, or by email to the address on your account. Legal notices to Jobiteer must be sent to jobiteer@gmail.com with a subject that describes the notice (for example, "Notice of Dispute," "Arbitration Opt-Out," or "Copyright Notice"). Other messages to that address may not be read or answered.
39. General Terms
- Entire agreement. These Terms, together with the Privacy Policy and the rules shown on the Platform, are the whole agreement between you and Jobiteer about the Platform, and replace any earlier agreements on the subject (except an earlier arbitration opt-out).
- Severability. If any part of these Terms can't be enforced, it will be enforced as far as the law allows, and the rest stays in effect.
- No waiver. If we don't enforce a part of these Terms, we haven't given up the right to enforce it later.
- Assignment. We may transfer these Terms, in whole or in part, including in a merger, acquisition, or sale of assets. You may not transfer them without our written consent.
- Force majeure. We aren't responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, war, terrorism, government action, power, internet, or telecommunications failures, cyberattacks, and failures of the outside services the Platform relies on.
- Relationship. Nothing in these Terms creates a partnership, joint venture, employment, agency, or fiduciary relationship between you and Jobiteer, or between Jobiteer and any user.
- No third-party beneficiaries, except the Jobiteer Parties in Sections 28, 30, and 31, and Apple as stated in Section 23.
- Interpretation. Headings and the summary in Section 2 are for convenience only. "Including" means "including without limitation." If these Terms are translated, the English version controls.
- Export and sanctions. You may not use the Platform if you are on a U.S. government list of restricted parties or in a country under U.S. embargo.
